
Probate
Probate is the process by which a court directs the distribution of a decedent’s property, either according to state statutes, or according to a will if the decedent had one. This process usually lasts at least 6 months and often more than a year.
The most commonly used tool to avoid the probate process is the living trust. This avoids probate by having a Trustee distribute your assets instead of an executor or personal representative under court supervision in probate.
In some cases, even where a trust is not used, probate may be avoided entirely or an abbreviated court process may be used.
